The H-1B visa is available to persons coming to the United States to work in a specialty occupation. Specialty occupation has been interpreted to mean a professional position or one that requires a minimum of a U.S. bachelor's degree or equivalent. Although some professional positions are defined by statute (such as Accountant or Attorney), it is not always clear which positions qualify for an H-1B position. Since there is not always a clear definition of specialty occupation, an Attorney is needed to research each position and present legal arguments in support of the offered position so that it is classified by USCIS as a specialty occupation.

The E-2 investor visa is available to nationals of certain countries that have entered into a treaty of friendship, commerce and navigation or Bilateral Investment Treaty or other arrangements with the United States [the countries are listed below]. The foreign national needs to have the intention to develop and direct the operations of a commercial enterprise in which the alien has invested, or is actively in the process of investing a substantial amount of capital in a U.S. enterprise. At least 50% of the stock of the U.S. company must be owned by nationals of the treaty country. The investment must be "at risk" and in the possession and control of the employer. The investment cannot be a passive investment such as stock or undeveloped land.

The L-1 visa allows the intra-company transference for persons who have been employed by a foreign company for at least 1 out of the last 3 years in a managerial or executive position, or a person with specialized knowledge, to a U.S. parent, subsidiary or affiliate. The L-1 visa can be renewed for a maximum of 7 years for executives and managers and 5 years for persons with specialized knowledge. As soon as the U.S. company is able to support a permanent executive or manager, the executive or manager will be able to apply for permanent residency through the U.S. company.
