Asylum & Removal

Political asylum is a form of protection that allows individuals who are in the United States to remain here, provided that they meet the definition of a refugee: Unable or unwilling to return to the home country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group or political opinion. If you are unable to provide substantial evidence to support your application for political asylum and you entered the United States without a proper visa or, if you entered with a visa and your stay has expired, you (and your family) will be placed in deportation (removal) proceedings automatically.

REMOVAL PROCEEDINGS:

"Removal" is the current term used by the Department of Homeland Security which means "deportation." If you are not a U.S. Citizen and if you have ever been arrested, you might be arrested and detained by the Department of Homeland Security and placed in removal proceedings. A plea of guilty or nolo contendere (no contest) or a finding of guilt by a judge or jury (including withhold of adjudication) may subject you to removal proceedings.
